Can my employer hold a disciplinary hearing without an investigation?

07/02/2025

In most cases, no! Under Irish employment law, employers must follow fair procedures, which include:

✅ Conducting an impartial investigation to establish facts
✅ Allowing you a chance to respond before any hearing
✅ Keeping the investigation and disciplinary process separate

Skipping the investigation stage could make the process unfair and legally challengeable, potentially leading to claims of unfair treatment or unfair dismissal if dismissed as a result.
